Residential Area Landscaping. The Developer has submitted a final landscaping plan for the residential areas of the development. As part of the conditional use permit, landscaping must be used to help mitigate nuisances. Berms, landscaping, and walls will help mitigate light and noise from trespassing on to neighboring properties. The Developer has committed to construct a masonry wall around the Wilde property that borders the southwest corner of the property. Developer shall install a six foot tall wall on the entire western boundary of Phase 2 (with the understanding that any portion of the wall within 30 feet of Main Street shall only be four feet tall), including the area just west of the northwest commercial parking lot. This wall is to mitigate light trespass from vehicles. To the east of the open space area of Phase 1, there is a line of garages that must be shielded from the view from Main Street and the center open area. The Developer has provided plans for twenty-three (23) trees in this area to shield the view of the garages. A five foot masonry wall shall be installed by the developer along the eastern boundary of Phase1 that will run from the north end of the spa commercial building to the southern boundary of the Xxxxxxx’ property directly east of the commercial parking lot.

  • Dimensions Education Bachelor’s Degree in Computer Science, Information Systems, or other related field. Or equivalent work experience. A minimum of 3 years of IT work experience with Web-related software and hardware products, and systems administration experience with multi-platform environments.

  • Miscellaneous The Vendor acknowledges and agrees that continued participation in TIPS is subject to TIPS sole discretion and that any Vendor may be removed from the participation in the Program at any time with or without cause. Nothing in the Agreement or in any other communication between TIPS and the Vendor may be construed as a guarantee that TIPS or TIPS Members will submit any orders at any time. TIPS reserves the right to request additional proposals for items or services already on Agreement at any time.

  • General The Trustee shall keep proper books of record and account of all the transactions of each Trust under this Indenture at its corporate trust office, including a record of the name and address of, and the Units issued by each Trust and held by, every Unit holder, and such books and records of each Trust shall be open to inspection by any Unit holder of such Trust at all reasonable times during the usual business hours. The Trustee shall make such annual or other reports as may from time to time be required under any applicable state or federal statute or rule or regulations thereunder.

  • Termination In the event that either Party seeks to terminate this DPA, they may do so by mutual written consent so long as the Service Agreement has lapsed or has been terminated. Either party may terminate this DPA and any service agreement or contract if the other party breaches any terms of this DPA.

  • Notices Any notice, request or other document required or permitted to be given or delivered to the Holder by the Company shall be delivered in accordance with the notice provisions of the Purchase Agreement.

  • Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
