Common use of RESIDENT’S RIGHTS Clause in Contracts

RESIDENT’S RIGHTS. In the event of a violation of any of the provisions hereof, OHFA, its successors, designees and assigns, and any individual who is or intends to become an Oklahoma resident, who meets the Income limitations set forth in this Agreement (such individual may be a former, present or prospective Resident of the Development) may institute and prosecute any proceeding at law or in equity to xxxxx, prevent or enjoin any such violation or attempted violation, or to recover monetary damages caused by such violation or attempted violation. The provisions hereof are imposed upon and made applicable to the Development and shall run with the Land and shall be enforceable against Owner and each Transferee, assignee, successor in interest, purchaser, grantee or lessee (but not including Residents) of the Development or any portion thereof at any time and from time to time, and the respective heirs, legal representatives, successors and assigns of Owner and each such Transferee, Assignee, successor in interest, purchaser, grantee or lessee. No delay in enforcing the provisions hereof as to any breach or violation shall impair, damage, or waive the right of any party entitled to enforce the same or obtain relief against or recover for the continuation or repetition of such breach or violation or any similar breach or violation thereof at any later time or times.
