Resignation of Trustees. A Trustee may resign at any time, with or without cause, by giving written notice by certified mail to the Trustor and to each Unit Owner. Such resignation shall be effective as of the date specified in such Notice. The resigning Trustee shall account to its successor for the administration of the Trust Estate as may be required by the Successor Trustee. All successors to such resigning Trustee shall be fully protected in relying upon such accounting.
Resignation of Trustees. Any Trustee may resign at any time by delivering to any other Trustee and to the office of PREIT notification in record form of his or her resignation, which resignation shall be effective when received, but if the effect of such resignation shall be to reduce the number of Trustees below five (5), no such resignation shall be effective until a successor shall have been elected by the remaining Trustees.
Resignation of Trustees. Section 8.03
Resignation of Trustees. A Trustee may resign upon giving thirty (30) calendar days’ notice in writing to the Chairperson of the Board of Trustees. Unless otherwise specified in such written notice, such resignation shall take effect upon receipt thereof by the Chairman or by such other officer, and the acceptance of such resignation shall not be necessary to make it effective. The Agency may appoint the alternate to take over as the Trustee or may appoint another eligible representative to serve the remaining term.
Resignation of Trustees. Any Trustee may resign his office by an instrument in writing signed by such Trustee and delivered to the Board of Trustees, which resignation shall take effect after such delivery and on the date indicated in such instrument; provided, that such resignation shall not become effective until a copy of such instrument shall have been duly filed for record by such resigning Trustee.
Resignation of Trustees. Any Trustee hereunder may resign by an instrument in writing delivered to the remaining Trustees, or, if there are no remaining Trustees, to all Shareholders.
Resignation of Trustees. A Trustee may resign upon giving a minimum of thirty (30) day’s written notice to the remaining Trustees in which notice there shall be stated a date when such resignation shall take effect. Such resignation shall take effect on the date specified in the notice or on another alternate date, unless a successor Trustee shall have been appointed at an earlier date, in which event such resignation shall take effect immediately upon the appointment of said successor Trustee. The remaining Trustees shall establish the effective date of a Trustee’s resignation if the resigning Trustee does not state a date when the resignation takes place. The appointment of successor Trustees shall be made by the President and subject to ratification by the Board of Directors. In the event that the Board or Directors refuses to ratify the appointment of a successor Trustee, the successor Trustee shall be removed and the President shall nominate an alternate successor Trustee, subject to ratification by the Board of Directors.
Resignation of Trustees. Any Trustee may resign upon sixty (60) days prior written notice to the Depositor. If no successor has been appointed within such sixty (60) day period, the resigning Trustee may, at the expense of the Trust, petition a court to appoint a successor trustee.
Resignation of Trustees. A Trustee may resign upon giving a minimum of thirty (30) days' written notice to the remaining Trustees and to the group he represents in which notice there shall be stated a date when such resignation shall take effect. Such resignation shall take effect on the date specified in the notice or on another alternate date, unless a successor Trustee shall have been selected at an earlier date, in which event such resignation shall take effect immediately upon the selection of said successor Trustee. The entity appointing the resigning Trustee may establish the effective date of a Trustee resignation (and such date may be earlier or later than the date specified by the Trustee).
Resignation of Trustees. Any Trustee acting hereunder shall have the right to resign as Trustee at any time. Each successor Trustee shall have all the powers, authorities and discretions herein conferred upon the Trustees, and may accept the property tendered by the predecessor or predecessors in trust as constituting the entire trust; and, upon such terms as it deems best, may compromise or abandon entirely any or all claims against each predecessor Trustee, without liability to any beneficiary by so doing.
