Common use of Resignation or Death of the Trustee Clause in Contracts

Resignation or Death of the Trustee. Any trustee may resign by giving thirty days written notice to the Grantor and to each beneficiary. Such resignation shall be effective 30 days from the date notice is given. In the event of resignation, death or incapacity of , as Trustee, then shall serve as Successor Trustee. If all enumerated Trustee, named above, are unable or unwilling to act, the beneficiaries who are sui juris, and if not, through their guardian, may, by a majority in number, designate a Trustee to act, subject to those provisions of this Trust regarding the ability of the beneficiary to make such a designation. Such appointment shall be in writing and executed in the presence of two (2) subscribing witnesses.
