Responsibilities of the School. 1. The SCHOOL will plan and determine the adequacy of the educational experience of the students in theoretical background, basic skill, professional ethics, attitude and behavior and shall assign to the HOST AGENCY only those students who have satisfactorily completed the prerequisite didactic portions of the SCHOOL’s curriculum. 2. The SCHOOL will retain ultimate responsibility for the education and assessment of its students. The School’s representative for this Agreement shall be a faculty member appointed and assigned by the SCHOOL, who will be responsible for medical student teaching and assessment provided pursuant to this Agreement. 3. The SCHOOL will advise all students assigned to the HOST AGENCY facilities regarding the confidentiality of patient/client records and patient/client information imparted during the training experience. The SCHOOL will also advise all students that the confidentiality requirements survive the termination or expiration of this AGREEMENT. 4. The SCHOOL will require all participating students to maintain health insurance and provide proof of health insurance to the School. The HOST AGENCY may request the student provide proof of health insurance prior to beginning of the training experience. 5. The SCHOOL will require all participating students to have completed an appropriate criminal background check, and to have documented appropriate immunizations on file with the SCHOOL. If applicable, the HOST AGENCY shall notify the student of any requests for evidence of criminal background test or immunization. The SCHOOL will inform the student of his/her responsibility to provide evidence to the HOST AGENCY of any required criminal background checks or immunizations, when requested. The HOST AGENCY shall notify the SCHOOL of its requirements of an acceptable criminal background check and required immunizations. The SCHOOL will also inform students that they may be required to undergo a drug test or other similar screening tests pursuant to the HOST AGENCY’S policies and practices, and that the cost of any such test will be paid by the student, if not the HOST AGENCY. 6. The SCHOOL will advise students that they are required to comply with HOST AGENCY rules, regulations, and procedures. 7. If requested by the HOST AGENCY, the SCHOOL will provide instruction to the HOST AGENCY'S staff with respect to the SCHOOL’s expectations regarding assessment of the SCHOOL'S students at the HOST AGENCY. 8. The SCHOOL warrants and represents that it provides occurrence-based liability insurance or self-insurance for its students with limits of at least $1,000,000 per occurrence and $3,000,000 annual aggregate. However, if the SCHOOL is a public entity entitled to governmental immunity protections under applicable state law, then the SCHOOL shall provide occurrence-based liability coverage in accordance with any limitations associated with the applicable law; but the SCHOOL shall provide such insurance with limits of at least $1,000,000 per occurrence and $3,000,000 annual aggregate in the event governmental immunity protections are determined by a court of competent jurisdiction to not apply. If requested by the HOST AGENCY, the SCHOOL shall provide a certificate of insurance demonstrating coverage for students completing clinical training at the HOST AGENCY.

The SCHOOL will also advise instruct all students that the confidentiality requirements survive the termination or expiration of this AGREEMENT. 4. The SCHOOL will require all participating students to maintain health insurance and provide proof of health insurance to the School. The HOST AGENCY may request the student provide proof of health insurance prior to beginning of the training experience. 5. The SCHOOL will require all participating students to have completed provide proof of health insurance. In the event of an appropriate criminal background checkemergency, and to have documented appropriate immunizations on file with the SCHOOL. If applicable, the HOST AGENCY shall notify the student of any requests for evidence of criminal background test or immunizationwill provide such emergency care as is provided its employees. The SCHOOL will inform the student of his/her responsibility to provide evidence to the HOST AGENCY of any required criminal background checks or immunizations, when requested. The HOST AGENCY shall notify the SCHOOL of its requirements of an acceptable criminal background check and required immunizations. The SCHOOL will also inform students that they may be required to undergo a drug test or other similar screening tests pursuant to the HOST AGENCY’S policies and practices, and that the cost of any such test will be paid by responsible for any charges thus generated if the student, if charges are not covered under the HOST AGENCYColorado Workers’ Compensation Act. 6. The SCHOOL will advise require all participating students that they are to have passed a criminal background check and to have documented appropriate immunizations. If applicable, the AGENCY shall notify the SCHOOL of any requests for evidence of immunization. The SCHOOL will then provide evidence to the AGENCY of any required to comply immunizations for its students. 7. The SCHOOL will encourage student compliance with HOST AGENCY rules, regulations, and procedures. 7, and use its best efforts to keep students informed as to the same and any changes therein. If requested by the HOST AGENCYSpecifically, the SCHOOL will provide instruction to the HOST AGENCY'S staff with respect to the SCHOOL’s expectations regarding assessment keep each participating student apprised of the SCHOOL'S students his or her responsibilities at the HOST AGENCY. 8. The SCHOOL’s educational programs, activities, and services offered to students, faculty, and/or employees are administered on a nondiscriminatory basis subject to the provisions of Title VI and VII of the Civil Rights Act of 1964, Titles VII and VIII of the Public Health Services Act, the Rehabilitation Act of 1973 (Section 504), the Equal Pay Act of 1963 as amended, Title IX of the Educational Amendments of 1972, the Vietnam Era Veteran’s Readjustment Assistance Act of 1974, and the nondiscrimination laws of the State of Colorado. 9. The SCHOOL warrants and represents that it provides occurrenceself-based insures for professional liability insurance or for itself and for its public employees and students who provide health care services pursuant to the Colorado Governmental Immunity Act (C.R.S. §§00-00-000 through 24-10- 120). The SCHOOL agrees that its self-insurance for its students with limits of at least $1,000,000 per occurrence and $3,000,000 annual aggregate. However, if the SCHOOL is a public entity entitled to governmental immunity protections under applicable state law, then the SCHOOL shall program will provide occurrence-based liability coverage in accordance with any limitations associated with the applicable law; but the SCHOOL shall provide such insurance with limits of at least the Colorado Governmental Immunity Act. The Colorado Governmental Immunity Act provides that the maximum amount that may be recovered against a public entity, public employee or student will be (a) $1,000,000 per 350,000 for any injury to one person in a single occurrence, and (b) $990,000 for any injury to two or more persons in any single occurrence and (except that no person may recover in excess of $3,000,000 annual aggregate 350,000). For those approved activities that take place in a state other than Colorado, or in the event governmental immunity protections are determined by a court of competent jurisdiction to determines on final judgment that the limits of the Colorado Governmental Immunity Act do not apply. If requested by the HOST AGENCY, the University of Colorado Self-Insurance and Risk Management Trust has provided for professional liability insurance coverage of at or above $1,000,000/$3,000,000 through a commercial insurance policy, to the extent that such policy would cover the actions of students from the SCHOOL shall provide a certificate participating under this Agreement. 10. Further, all students subject to the provisions of insurance demonstrating C.R.S. §§ 8-40-101 et seq., and participating in educational programs conducted by or administered through the SCHOOL, will be covered under the Colorado Workers’ Compensation Act. The SCHOOL will be responsible for providing workers’ compensation and liability coverage for students completing clinical training of SCHOOL at the HOST AGENCY. 11. The SCHOOL shall inform its students that they must obtain prior written approval from AGENCY and the SCHOOL before publishing any material related to the clinical educational experience.
