Responsibility for Construction Safety. The Contractor shall be solely responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the Work Areas. The Contractor shall comply with all applicable laws, ordinances, rules, regulations and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. The Contractor shall take all reasonable precautions for the safety of all personnel on-site employees on the Work and all other persons who may be affected thereby. The Contractor shall designate a Competent Person who is a responsible member of his organization whose duty shall be the prevention of accidents. A Competent Person is one who can identify hazards and take steps to control hazards and understand OSHA regulatory standards and maintains strict standards in Work Areas, such as excavation. Except as otherwise stated in the Contract, if the Contractor encounters any materials reasonably believed to be mold, asbestos, lead or polychlorinated biphenyl (PCB) on the Project site, the Contractor shall immediately stop work in the area affected and give notice of the condition to the Owner. The Contractor shall not resume the Work in the affected area without written direction by the Owner.
