Restricted Contact. Reviewer (and Reviewer shall so direct its Representatives), shall not (except when required by Law or in the ordinary course of business unrelated to the Transaction) (i) directly or indirectly communicate regarding the Transaction or Confidential Information with any person known to be a tenant, property manager, leasing agent, service contractor, lien holder or other persons with any known interest in or contractual relationship affecting the Property; (ii) directly or indirectly communicate with any governmental authorities or agencies relating to the Property, the Transaction, or the Confidential Information; or (iii) make any inspection of the non-public areas of the Property in connection with the Transaction, except as may hereafter be agreed to in a separate written agreement entered into by or on behalf of Brookfield and Reviewer.

Restricted Contact. No Recipient shall make or have any contact with any Representative, supplier, customer or subcontractor of the Discloser or the Group in relation to the Proposed Transaction (the "Restricted Parties"), other than those Restricted Parties specifically identified in writing by the Discloser for this purpose. Nothing in this Agreement shall prevent a Recipient from (a) contacting Restricted Parties in the ordinary course of business without reference to the Proposed Transaction and/or (b) conducting any ordinary course of business commercial or market review, provided that such review is conducted (i) on a "no names" basis, (ii) without reference to the Proposed Transaction, (iii) without disclosing any Information and (iv) without treating the Group differently than any other party in the relevant industry.

Restricted Contact. You acknowledge that you may only contact those employees, officers or directors of the Company as designated by Bellatrix or its advisors from time to time in writing with respect to a Possible Transaction. Pursuant to this letter agreement, the designees currently are Xxxxxxx Xxxxx, Executive Vice-President, General Counsel & Corporate Secretary, and Xxxxx Able, Executive Vice-President and Chief Financial Officer. Without Bellatrix’s prior written consent, neither you nor any of your Representatives will initiate or cause to be initiated or maintain any communication with any other officer, director or employee of the Company. In addition, in consideration of and as a condition to the Confidential Information being furnished to you, you hereby agree that neither you nor any of your Representatives shall initiate or cause to be initiated or maintained any communication with any customer, creditor, shareholder, vendor, supplier or service provider of or to the Company concerning its relationship with the Company, the Confidential Information (including the Discussion Information) or any potential transaction with the Company without obtaining the prior written consent of Bellatrix. You are permitted to directly contact Goodmans LLP and BMO Xxxxxxx Xxxxx Inc. with respect to a Possible Transaction. You hereby further agree that neither you or any of your Representatives shall use the Confidential Information (including the Discussion Information) to obtain any commercial advantage over Bellatrix or in any way which is or may be reasonably expected to be directly or indirectly detrimental to Bellatrix. The foregoing is not intended to restrict (i) contacts in the ordinary course of business, or (ii) general market diligence, provided you do not reveal any Confidential Information (including Discussion Information).
