Restricted Duties. Employee agrees not to disclose, or use for the benefit of the Company, any confidential or proprietary information belonging to any predecessor employer(s) that otherwise has not been made public and further acknowledges that the Company has specifically instructed him not to disclose or use such confidential or proprietary information. Based on his understanding of the anticipated duties and responsibilities hereunder, Employee acknowledges that such duties and responsibilities will not compel the disclosure or use of any such confidential and proprietary information.

Restricted Duties. 28.1 No Employee shall be required to administer medication to students. 28.2 No Employee shall be required to regularly perform work outside of his/her job discipline.
Restricted Duties. (a) No employee shall be required to dispense medication or perform medical procedures on students. (b) No employee shall be required to perform work inconsistent with duties performed by other employees in their classification in the District. Notwithstanding the foregoing, the District retains the right to assign new duties not previously assigned to staff and to restructure positions as deemed necessary. (d) Employees shall not be responsible for developing written lesson plans, nor shall they be responsible for introducing new material to students in lieu of a certified staff member. However, employees may be directed to follow lesson plans written by a certified staff member for the purpose of reinforcing concepts previously introduced by the certified staff member. Modification of assignments or other material for students shall not be considered development of lesson plans. (e) Employees may be asked to supervise a classroom in the teacher's absence. Employees shall assist substitute teachers with the location of classroom materials, seating charts, lesson plans, and school routines. (f) Employees shall not be used as a substitute teacher unless they are legally qualified to be a substitute teacher. In such cases, the employee shall be paid his/her regular rate of pay for the day plus $25 for up to three hours of substitute teacher work or $50 for three or more hours of substitute teacher work.
Restricted Duties. Paraprofessionals shall not be responsible for developing written lesson plans nor shall they be responsible for introducing new material to students in lieu of a certified staff member. Paraprofessionals may be directed to follow lesson plans written by a certified staff member for the purpose of reinforcing concepts previously introduced by the certified staff member. Paraprofessionals shall not be used as substitute teachers. Paraprofessionals shall not be left unsupervised by a certified staff member to perform instructional duties. Paraprofessionals may be left unsupervised by a certified staff member in non-instructional settings; this may be done only for relatively short periods (10 minutes or less) and not for the purpose of releasing the teacher from duty. Paraprofessionals shall not be assigned office work. Paraprofessionals shall not be used in place of a daily substitute secretary. Paraprofessionals who are interested in performing crossing guard duty, should there be a District need for such, shall submit an application to Human Resources. Pay for crossing guard duty shall be determined through mutual discussions between the District Chief Financial Officer and the Union President, if the need for crossing guard duty arises. Paraprofessionals shall not perform crossing guard duty unless trained to do so.
Restricted Duties. Where possible the Employer will endeavour to assist an Employee who is on restricted duties to overtime that is within their capability in accordance with any medical or other restriction. The Employer will consider any request but only upon receiving a request in writing and if required by the Employer provide a medical certificate from their treating doctor to certify the Employee's abilities.
Restricted Duties. The provisions of this Agreement, to the extent that they restrict the duties and liabilities of an Indemnified Party otherwise existing at law or in equity, are agreed by the Parties hereto to replace such other duties and liabilities of such Indemnified Party, to the maximum extent permitted by applicable law.

  • Additional Duties (i) In addition to the duties of the Administrator set forth in Section 1(a), the Administrator shall perform such calculations, and shall prepare, execute and file or deliver on behalf of the Issuer or the Owner Trustee or shall cause the preparation by other appropriate persons of all such documents, reports, notices, filings, instruments, certificates and opinions as it shall be the duty of the Issuer or the Owner Trustee to prepare, file or deliver pursuant to the Basic Documents, and at the request of the Owner Trustee shall take all appropriate action with respect thereto, that is the duty of the Issuer or the Owner Trustee to take pursuant to the Basic Documents. Subject to Section 5 of this Agreement, and in accordance with the reasonable written directions of the Owner Trustee, the Administrator shall administer, perform or supervise the performance of such other activities in connection with the Basic Documents as are not covered by any of the foregoing provisions and as are expressly requested by the Owner Trustee and are reasonably within the capability of the Administrator. The responsibilities of the Administrator shall include the execution and delivery of any filings, certificates, affidavits or other instruments required under the ▇▇▇▇▇▇▇▇-▇▇▇▇▇ Act of 2002, to the extent permitted by applicable law, and the Owner Trustee hereby requests that the Administrator perform such obligations. (ii) Notwithstanding anything in this Agreement or the Basic Documents to the contrary, the Administrator shall be responsible for promptly notifying the Owner Trustee in the event that any withholding tax is imposed on the Issuer’s payments (or allocations of income) to the Certificateholder as contemplated in Section 5.02(c) of the Trust Agreement. Any such notice shall specify the amount of any withholding tax required to be withheld by the Owner Trustee pursuant to such provision. (iii) Notwithstanding anything in this Agreement or the Basic Documents to the contrary, the Administrator shall be responsible for performance of the duties set forth in Sections 5.04(a), (b), (c), (d) and (e) of the Trust Agreement with respect to, among other things, accounting and reports to the Certificateholder. (iv) The Administrator shall perform the duties of the Administrator specified in Section 10.02 of the Trust Agreement required to be performed in connection with the resignation or removal of the Owner Trustee and any other duties expressly required to be performed by the Administrator under the Trust Agreement. (v) In carrying out the foregoing duties or any of its other obligations under this Agreement, the Administrator may enter into transactions with or otherwise deal with any of its Affiliates; provided, however, that the terms of any such transactions or dealings shall be in accordance with any directions received from the Issuer and shall be, in the Administrator’s opinion, no less favorable to the Issuer than would be available from unaffiliated parties. (vi) The Administrator shall provide notices to the Rating Agencies as required under the Basic Documents. (vii) It shall be the Administrator’s duty and responsibility, and not the Owner Trustee’s duty or responsibility, to cause the Issuer to respond to, defend, participate in or otherwise act in connection with any regulatory, administrative, governmental, investigative or other proceeding or inquiry relating in any way to the Issuer, its assets or the conduct of its business.
