Retention of Certificated Staff. Step Three 25 In the event of a Reduction in Force, the most senior qualified non-administrative employees, 26 as ranked on the seniority list, shall be retained in accordance with the following procedures 27 and criteria: Although the District will take reasonable steps to cause as little disruption to the 28 current staffing assignments, the District shall be entitled to determine programmatic need and 29 place employees in positions based upon that need, considering the qualifications and 30 experience of the certificated employee and the overall needs of the District. Retaining senior 31 staff members is a paramount priority. To this end the District will advise and assist employees 32 in the options for out-of-endorsement waivers and/or emergency certification. Employees may 33 only be retained in a position where the employee meets the minimum State certification 34 requirements for the position. 36 No part-time employee will be offered a position in excess of current contractual status until 37 the Employment Pool is depleted. 39 Subsection (E): Non-Renewal and/or Adversely AffectedStep Four 40 If, after the District has filled all of the available positions with qualified and more senior staff, 41 and an employee has not been placed in a position, he/she will be non-renewed in whole or for 42 part of his/her contract and placed in the Employment Pool. Non-renewed employees will be 43 notified in writing of their status on or before May 15, or the statutory deadline for such 44 notices, whichever is later.

  • Replacement of Certificates If (i) any Certificate is mutilated and is surrendered to the Trustee or any Authenticating Agent or (ii) the Trustee or any Authenticating Agent receives evidence to its satisfaction of the destruction, loss or theft of any Certificate, and there is delivered to the Trustee or the Authenticating Agent such security or indemnity as may be required by them to save each of them harmless, then, in the absence of notice to the Depositor and any Authenticating Agent that such destroyed, lost or stolen Certificate has been acquired by a bona fide purchaser, the Trustee shall execute and the Trustee or any Authenticating Agent shall authenticate and deliver, in exchange for or in lieu of any such mutilated, destroyed, lost or stolen Certificate, a new Certificate of like tenor and Certificate Principal Amount. Upon the issuance of any new Certificate under this Section 3.05, the Trustee and Authenticating Agent may require the payment of a sum sufficient to cover any tax or other governmental charge that may be imposed in relation thereto and any other expenses (including the fees and expenses of the Trustee or the Authenticating Agent) connected therewith. Any replacement Certificate issued pursuant to this Section 3.05 shall constitute complete and indefeasible evidence of ownership in the applicable Trust Fund, as if originally issued, whether or not the lost, stolen or destroyed Certificate shall be found at any time.
