Retention of Customer and Employee Information. Subject to the further provisions of this Section 4A(c), BNYM will not retain any Customer and Employee Information that is not Current Qualifying Confidential Information for any period longer than necessary for BNYM to fulfill its obligations under this Agreement. As soon as BNYM no longer needs to retain Customer and Employee Information that is not Current Qualifying Confidential Information in order to perform its duties under this Agreement, BNYM will return or destroy or erase all originals and copies of such Customer and Employee Information in accordance to its retention policies. Any Customer and Employee Information that is not Current Qualifying Confidential Information retained by BNYM after it is no longer needed for BNYM to perform its duties under this Agreement or retained by BNYM beyond expiration or termination of this Agreement shall continue to be subject to BNYM’s obligations with respect to Customer and Employee Information under this Agreement.
