Common use of Retention of Duties Option Clause in Contracts

Retention of Duties Option. 3.1 In situations where a portion of a full-time transportation department employee’s daily hours are terminated or reduced, the remainder of the daily duties may be retained. Example - When an employee holds two postings and one is terminated or reduced the other posting may be retained. The bumping procedure in this example would deal with only the one posting that was terminated or reduced and would result in the employee bumping a position, within the transportation department only, that when combined with the retained posting would not exceed 40 hours per week.
