Common use of Return From a Voluntary (Non Clause in Contracts

Return From a Voluntary (Non. Medical) Leave of Absence - Teachers shall be entitled to return from an approved full year voluntary (non-medical) leave of absence to a position for which he/she is certified and qualified at the beginning of the next academic quarter following its expiration if a position is available. In the event that an open position is not available, every effort will be made to place the returning teacher in a position (i.e., reassignments) However, if no position can be made available, the teacher may be granted a leave extension for another year (or until a position becomes available for which he/she is certified and qualified during that year). In the event that reassignments are required in order to determine this placement, state law and district policy/procedures shall be followed. Such teachers shall provide written notice of their intent to return to the school district by March 1 for return at the beginning of the first semester of the next school year, or sixty (60) days prior to the beginning of any subsequent academic quarter for which they intend to return. The school district shall, at the time a leave is granted, inform such teachers of the procedures for advising the district of their intent, of the appropriate deadline for doing so, and of the consequences for failing to do so. Under these circumstances, the failure of such teachers to provide timely notification of their intent to return shall constitute an irrevocable voluntary resignation.
