Common use of Return of Performance Bank Guarantee Clause in Contracts

Return of Performance Bank Guarantee. Payment on Order Instrument 3.4.1 Subject to Article 3.3, SECI shall return / release the Performance Bank Guarantee/ Payment on Order Instrument immediately after the successful Commissioning of the Project after taking into account any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement. 3.4.2 The return / release of the Performance Bank Guarantee/ Payment on Order Instrument shall be without prejudice to other rights of SECI under this Agreement.

Return of Performance Bank Guarantee. Return of Performance Bank Guarantee. Return of Performance Bank Guarantee. Payment on Order Instrument 3.4.1 Subject to Article 3.33.2, SECI shall return / return/ release the Performance Bank Guarantee/ Payment on Order Instrument immediately within 30 days after the successful Commissioning full commissioning of the Project after taking into account any liquidated damages / penalties due to delays in commissioning of the project beyond SCD as per provisions stipulated in this Agreement. 3.4.2 The return / release of the Performance Bank Guarantee/ Payment on Order Instrument shall be without prejudice to other rights of SECI SECI/LEDA/LED under this Agreement.

Return of Performance Bank Guarantee. Payment on Order Instrument 3.4.1 3.3.1 Subject to Article 3.33.2, SECI shall return / release the Performance Bank Guarantee/ Guarantee / Payment on Order Instrument immediately upon completion of one year after commencement of supply of power from the successful Commissioning of last part capacity/capacity finally accepted under the Project PPA, after taking into account any liquidated damages / penalties penalty due to delays in commissioning commencement of power supply beyond the SCSD and performance shortfall in supply of power as per provisions stipulated in this Agreement. 3.4.2 3.3.2 The return / release of the Performance Bank Guarantee/ Guarantee / Payment on Order Instrument shall be without prejudice to other rights of SECI under this Agreement.
