Common use of Return of Performance Bank Guarantee Clause in Contracts

Return of Performance Bank Guarantee. 3.4.1 Subject to Article 3.3, NTPC shall return / release the Performance Bank Guarantee three (03) months after Commercial Operation Declaration of the Project after adjustment any liquidated damages / penalties due to delays in commissioning as per provisions stipulated in this Agreement 3.4.2 The return / release of the Performance Bank Guarantee shall be without prejudice to other rights of NTPC under this Agreement.
