Common use of Return or Destruction of Protected Health Information upon Termination Clause in Contracts

Return or Destruction of Protected Health Information upon Termination. Upon termination of this Addendum, Business Associate shall either return or destroy all Protected Health Information received from the Covered Entity or created or received by Business Associate on behalf of the Covered Entity and which Business Associate still maintains in any form. Business Associate shall not retain any copies of such Protected Health Information. Notwithstanding the foregoing, to the extent that the Covered Entity agrees that it is not feasible to return or destroy such Protected Health Information, the terms and provisions of this Addendum shall survive such termination and such Protected Health Information shall be used or disclosed solely for such purpose or purposes which prevented the return or destruction of such Protected Health Information.

Notwithstanding the foregoing, to the extent that the Covered Entity agrees and Business Associate mutually determine that it is not feasible to return or destroy such Protected Health Information, the terms and provisions of this Addendum BA Agreement shall survive such termination with regard to the Protected Health Information still in the possession of Business Associate, and such Protected Health Information shall be used or disclosed solely for such purpose or purposes which prevented the return or destruction of such Protected Health Information.

Business Associate Manager shall notify PRACTICE of any such destruction. Manager shall not retain any copies of such Protected Health Information. Notwithstanding In the foregoing, to the extent event that the Covered Entity agrees PRACTICE and Manager mutually agree that it is not feasible to return or destroy such Protected Health Information, the terms and provisions of this Addendum Article B shall survive such termination of this Agreement and such Protected Health Information shall be used or and disclosed solely for such purpose or purposes purposes, which prevented the return or destruction of such Protected Health Information.
