Common use of Return to Work on Conclusion of Parental Leave Clause in Contracts

Return to Work on Conclusion of Parental Leave. (i) An employee shall confirm their intention to conclude their parental leave or extended unpaid parental leave and return to work by notice in writing to their employer not less than four weeks prior to the expiration of parental leave or extended unpaid parental leave. (ii) An employee who intends to return to work on a modified basis in accordance with paragraph 28.9(d) shall advise their employer of this intention by notice in writing not less than four weeks prior to the expiration of parental leave or extended unpaid parental leave. (b) An employee on return to work following the conclusion of parental leave or extended unpaid parental leave will be entitled to the same position or a position equivalent in pay, conditions and status and commensurate with the employee’s skill and abilities as the substantive position held immediately prior to proceeding on parental leave. (c) Where an employee was transferred to a safe job or was absent from the workplace on full pay as provided for in “sub-clause 28.5 – Modification of Duties or Transfer to a Safe Job”, the employee is entitled to return to the position occupied immediately prior to the transfer or their absence from the workplace on full pay. (d) Right to return to work on a modified basis (i) An employee may return on a part time or job-share basis to the substantive position occupied prior to the commencement of leave or to a different position at the same classification level in accordance with the part time employment provisions of this Agreement. (ii) An employee may return on a modified basis that involves the employee working on different days or at different times, or both; or on fewer days or for fewer hours or both, than the employee worked immediately before starting parental leave.
