Common use of Review and Approval Process Clause in Contracts

Review and Approval Process. 20. With respect to any submission under Section II of this Consent Agreement that requires the approval of the Director, the Director may: (a) approve, in whole or in part, the submission, (b) approve the submission on specified conditions, (c) disapprove, in whole or in part, the submission, or (d) any combination of the foregoing. If the Director approves, approves in part, or approves with conditions, Respondent will take all action as approved by the Director, subject to Respondent's right to invoke the dispute resolution procedures in Section IV with respect to any conditions the Director identifies. If the Director disapproves all or any portion of the submission, the Director will provide Respondent with a written notice of the deficiencies. Respondent will correct all deficiencies within the time specified by the Director and resubmit it for approval.

If In the Director approvesevent of approval in whole, approves in part, or approves with upon conditions, Respondent KMLT will proceed to take all action actions required by the submission as approved modified by the Director, subject to Respondent's ’s right to invoke the dispute resolution procedures in Section IV with respect to any conditions identified by the Director. In the event the Director identifies. If the Director disapproves does not accept all or any portion of the a submission, the Director will provide Respondent KMLT with a written notice of the deficiencies. Respondent will correct all deficiencies within the time specified by the Director and resubmit it for approvalacceptance. If Respondent fails to correct the specified deficiencies, the Director may invoke the dispute resolution process provided in Section IV below.

If the Region Director approves, approves in part, or approves with conditions, Respondent will take all action as approved by the Director, subject to Respondent's right to invoke the dispute resolution procedures in Section IV V with respect to any conditions the Director identifies. If the Director disapproves all or any portion of the submission, the Director will provide Respondent with a written notice of the deficiencies. Respondent will correct all deficiencies within the time specified by the Director and resubmit it for approval.

With respect to any submission under Section II IV (Compliance Order) of this Consent Agreement that requires the approval of the Director, the Director may: (a) approve, in whole or in part, the submission, ; (b) approve the submission on specified specified, reasonable conditions, ; (c) disapprove, in whole or in part, the submission, ; or (d) any combination of the foregoing. If the Director approves, approves in part, or approves with conditions, Respondent will take all action actions as approved by the Director, subject to Respondent's ’s right to invoke the dispute resolution procedures in Section IV with respect to any conditions the Director identifies. If the Director disapproves all or any portion of the submission, the Director will provide Respondent with a written notice of the deficiencies. Respondent will correct all deficiencies within the time specified by the Director and resubmit it for approval.
