Common use of Review by the Association of Procurement Decisions Clause in Contracts

Review by the Association of Procurement Decisions. Except as the Association shall otherwise determine by notice to the Recipient, the following contracts shall be subject to Prior Review by the Association: (a) each contract procured for goods or non-consulting services estimated to cost the equivalent of $200,000 or more; (b) the first three (3) contracts for goods, non-consulting services, or works procured on the basis of National Competitive Bidding or Shopping, respectively; (c) each contract for goods, non-consulting services, or works procured on the basis of Direct Contracting; (d) each contract for works estimated to cost the equivalent of $500,000 or more; (e) each contract for consultants’ services provided by a firm estimated to cost the equivalent of $100,000 or more; (f) each contract for consultants’ services provided by an individual consultant estimated to cost the equivalent of $50,000 or more; (g) each contract for consultants’ services (provided by a firm or an individual) procured on the basis of Single Source Selection. All other contracts shall be subject to Post Review by the Association.

In addition, with respect to each contract for consultants’ services provided by an the employment of individual consultant consultants estimated to cost the equivalent of $50,000 or more; (g) each contract for consultants’ services (provided by a firm or an individual) procured , the report on the basis qualifications and experience of Single Source Selection. all evaluated candidates, the terms of reference and the terms of employment of the consultants shall be subject to prior approval by the Association All other contracts shall be subject to Post Review by the Association.

Except as the Association shall otherwise determine by notice to the RecipientBorrower, the following contracts shall be subject to Prior Review by the Association: (a) each contract procured for goods or non-consulting services estimated to cost the equivalent of $200,000 or more; (b) the first three (3) contracts for goods, non-consulting services, or works procured on the basis of National Competitive Bidding or Shopping, respectively; (c) each contract for goods, non-consulting services, or works procured on the basis of Direct Contracting; (di) each contract for works estimated to cost the equivalent of $500,000 or more, or (ii) each of the first three (3) contracts to be awarded through National competitive bidding irrespective of the estimate value, or (iii) each contract procured on the basis of Direct Contracting, (b) each contract for goods and services (other than consultants’ services), (i) estimated to cost the equivalent of $200,000 or more, or (ii) procured on the basis of Direct Contracting; and (ec) (i) each contract for consultants’ services provided by a firm estimated to cost the equivalent of $100,000 or more; , or (fii) each contract for consultants’ services provided by an individual consultant individual, estimated to cost the equivalent of $50,000 or more; , or (giii) each contract for consultants’ services (provided by a firm or an individual) procured on the basis of Single Source Selection. All other contracts shall be subject to Post Review by the Association, except for terms of references (TOR) for each service, which will be subject to prior review.

(b) for the Project Implementing Entity’s Respective Part of the Project: (i) each contract for goods estimated to cost the equivalent of $500,000 or more; and (ii) each contract for consultants’ services provided by an individual consultant a firm estimated to cost the equivalent of $50,000 200,000 or more; (giii) each contract for consultants’ services individual consultants estimated to cost the equivalent of $100,000 or more; and (provided by a firm or an individualiv) all contracts procured on the basis of Single Source Selectionsingle source or direct contracting. 2.
