Review Factors Considered by CMS. A Triggering Event may or may not require corrective action, depending on the totality of the circumstances. CMS will consider whether the State can demonstrate that a factor unrelated to this Agreement caused the Triggering Event. Notwithstanding the foregoing, CMS, at its sole discretion, will determine the sufficiency of the State’s response to any Warning Notice issued pursuant to this section.
