Revision or Redrafting of Construction Documents After Receipt of the Proposed GMP. (a) If the GMP Cost Limitation is exceeded by the Design-Builder’s proposed GMP, the Owner may. i. Approve an increase in the GMP Cost Limitation; or ii. Require the Design Builder, without additional compensation, to revise the Construction Documents to reduce the Cost of the Work to the GMP Cost Limitation; provided, however, if events causing the increase in the GMP are beyond the Design Builder’s control (e.g., a substantial unanticipated increase in the cost of construction materials), the cost of the redesign may be paid from the Design Contingency. (b) After the Design-Builder Contract has been awarded, if additional funding is obtained to increase the GMP Cost Limitation and components reduced or eliminated during design are desired to be reinstated, the Design Builder will be entitled to the same compensation as is provided for Change Orders not the fault of the Design Builder.
