REZONING AND OWNERSHIP. 26.4.1. This Agreement is subjecting to the condition precedent in that the Seller must obtain approval of the rezoning of the Land, by all relevant authorities, to enable the Seller to commence with the development of the Scheme and the construction of the Building on or before November 2021. 26.4.2. This Agreement is subject to the Seller becoming the registered owner of the Land in the Cape Town Deeds Registry on or before the Transfer Date. 26.4.3. In the event of anyone of the conditions referred to in Clauses 26.4 of this Agreement not being fulfilled, the Seller will refund the Purchaser all amounts paid in terms of this Agreement.
