Right of Union Participation. At any time, a member shall be afforded the right to Union Representation; the association, upon request, will have the right to inspect and observe any aspect of the drug or alcohol testing program with the exception of individual test results. The exercise of such right shall not unreasonably delay the collection of the sample. For alcohol tests, “unreasonable delay” means twenty (20) minutes or more. For drug tests, “unreasonable delay” means two (2) hours. The Association may inspect individual test results if the release of this information is authorized by the employee involved. The City shall notify the Union if the Administration knows in advance that drug or alcohol testing will take place.
