RIGHT-OF-WAY USE. The Company shall use the Agency's highway right-of-way only for the construction, operation, repair, replacement, and maintenance (collectively the Operations) of a longitudinal fiber optic broadband facility and associated communication facilities. Any other use of the right-of-way by the Company without prior written permission from the Agency shall constitute a breach of this Agreement.
