Common use of Right to Control Resolution Clause in Contracts

Right to Control Resolution. COMPANY will have the sole right and discretion to settle, compromise or otherwise resolve any and all claims, causes of actions, liabilities or damages against it, notwithstanding that COMPANY may have tendered its defense to BUSINESS ASSOCIATE. Any such resolution will not relieve BUSINESS ASSOCIATE of its obligation to indemnify COMPANY under this Section 3.3.

Right to Control Resolution. COMPANY Company will have the sole right and discretion to settle, compromise or otherwise resolve any and all claims, causes of actions, liabilities or damages against it, notwithstanding that COMPANY Company may have tendered its defense to BUSINESS ASSOCIATEBusiness Associate. Any such resolution will not relieve BUSINESS ASSOCIATE Business Associate of its obligation to indemnify COMPANY Company under Section F.11 of this Section 3.3Agreement.

COMPANY Organization will have the sole right and discretion to settle, compromise or otherwise resolve any and all claims, causes of actions, liabilities or damages against it, notwithstanding that COMPANY Organization may have tendered its defense to BUSINESS ASSOCIATEBusiness Associate. Any such resolution will not relieve BUSINESS ASSOCIATE Business Associate of its obligation to indemnify COMPANY Organization under this Section 3.34(c).
