Further, Concessionaire agrees that no liability shall attach to City, its officers, agents, and employees by reason of any efforts or action toward implementation of any present or future Master Layout Plan for DEN. Concessionaire agrees that no liability shall attach to City, its officers, agents, and employees by reason of any efforts or action toward implementation of any present or future Concessions Master Plan for DEN. Concessionaire waives any right to claim damages or other consideration arising therefrom.

Such right shall include the right of the County to terminate this Lease early if Xxxxxx's possession of the Leased Premises conflicts with, limits or interferes with proposed County development, renewal, replacement, or expansion of County properties or operation of the Airport, subject to the notice requirements contained in Section 3.02. Further, Xxxxxx agrees that no liability shall attach to County, its officers, agents, and employees by reason of any efforts or action toward implementation of any present or future master layout plan for the Airport. Tenant agrees that no liability shall attach to County, its officers, agents, and employees by reason of any efforts or action toward implementation of any present or future concessions master plan for the Airport. Tenant waives any right to claim damages or other consideration arising therefrom.
RIGHT TO DEVELOP AIRPORT. ‌ Concessionaire acknowledges City's responsibility to the public to prudently operate, maintain and develop the City's facilities. In executing this responsibility, City shall have the right to undertake developments, renewals, and replacements which the City deems prudent or necessary. Such right shall include the right of City to terminate this Agreement early in the event that Concessionaire's possession of the Premises conflicts with, limits or interferes with proposed City development, renewal, replacement or expansion of City properties or operation of the Airport, subject to the notice requirements contained in Section 2.04.
