Right to Know Law Provisions. 1. The Pennsylvania Right-to-Know Law (hereinafter referred to as the “RTKL”), 65 P.S. §§ 67.101-3104, applies to this Exempt Facilities Loan Agreement dated as of July 1, 2009 (this “Agreement”), between Pennsylvania Economic Development Financing Authority and Allegheny Energy Supply Company, LLC (the “Company”). For the purpose of administering the matters relating to the RTKL set forth in this Exhibit, the applicableCommonwealth agency” as provided in the RTKL shall be the Pennsylvania Economic Development Financing Authority, hereinafter referred to as the “Agency.” Capitalized terms used but not otherwise defined herein shall have the same meanings as in the RTKL.
