Your decision to opt out of Section 12 will have no adverse effect on your relationship with DISH or DISH’s delivery of Service(s) to you. Any opt-out not received within the thirty (30) day period set forth above will not be valid and you must pursue your Disputes (if any) as an individual action, either through binding arbitration or in small claims court, pursuant to and in accordance with Section 12 (excluding this Arbitration ProvisionSection 12(H), which in such event will no longer apply). If Customer or Comcast elect to resolve a Dispute through arbitration pursuant to this Arbitration Provision, the party initiating the arbitration proceeding may open a case with the American Arbitration Association - Case Filing Services, 0000 Xxxxxx Xxx Xxxx, Xxxxx 000, Xxxxxxxx, XX 00000, 877-493- 4185that lists your name, xxx.xxx.xxx address and account number and states that you are opting out of the arbitration clause. An opt out notice is only effective if it is signed by you, and the envelope that the opt out notice is sent in is postmarked no more than 30 calendar days after the date you sign this Agreement. If you opt out of this arbitration clause, it will not affect any other provisions of the Agreement or your obligations under the Commercial Arbitration Rules Agreement. If you do not properly opt out as set forth above, it will be effective as of the American Arbitration Association “AAAdate of the Agreement. If I opt out of this arbitration clause, such election shall apply only to this Agreement, and not to any other past, present or future agreements I have with you.
