Common use of Right to Regulate and Levels of Protection Clause in Contracts

Right to Regulate and Levels of Protection. 1. The Parties recognise the right of each Party to establish its own levels of domestic environmental and labour protection, and to adopt or modify accordingly its relevant laws and policies, consistently with internationally recognised standards and agreements to which they are a party.

The Parties recognise reaffirm the right of each Party respect for their respective Constitutions (42) and for their rights there under to regulate in order to set their own sustainable development priorities, to establish its their own levels of domestic environmental and labour social protection, and to adopt or modify accordingly its their relevant laws and policies, consistently with internationally recognised standards and agreements to which they are a party.

Each Party shall seek to ensure that those laws and policies provide for and encourage high levels of environmental protection, and shall strive to continue to improve such laws and policies and their underlying levels of protection.
