Common use of Right to Use Clause in Contracts

Right to Use. CloudNine will provide you with use of CloudNine Software. Your use of the Service shall be deemed to be your agreement to abide by this Agreement. With respect to CloudNine Software as a Service products use includes a browser interface and data encryption, transmission, access and storage. CloudNine permits You to use the Program(s) only in accordance with the terms of this Agreement. Subject to Your payment of the Subscription Fees set forth in the Software Order and Your compliance with the other terms of this Agreement, CloudNine grants to You a limited, personal, non-exclusive, nontransferable and non- assignable (except as this Agreement otherwise provides) right to use the Program and Documentation during the Term as set forth in this Agreement.

CloudNine permits You to use the Program(s) only in accordance with the terms of this Agreement. Subject to Your payment of the Subscription Fees set forth in the Software Order and Your compliance with the other terms of this Agreement, CloudNine grants to You a limited, personal, non-exclusive, nontransferable and non- assignable (except as this Agreement otherwise provides) right to use the Program and Documentation during the Term as set forth in this Agreement.
