Rights and Obligations Not Affected. Neither the Contractor’s rights or remedies, nor the Subcontractor’s obligations under the Subcontract or otherwise at law or in equity, whether before or after the expiration of the Defects Liability Period, will be affected or limited by: the rights conferred upon the Contractor or Contractor’s Representative by clause 17 or the failure by the Contractor or the Contractor’s Representative to exercise any such rights; the obligations imposed upon the Subcontractor by clause 17 or the Subcontractor’s compliance with those obligations; or any direction of the Contractor’s Representative under or purported to be given under the Subcontract, including any comment or direction upon or review, acceptance or rejection of: any advice, recommendation or other assistance provided by the Subcontractor under clause 17; or any post occupancy evaluation carried out (including any report prepared and finalised) under clause 17.4.

Neither the Commonwealth's rights or remedies, nor the Consultant's obligations under the Contract or otherwise at law or in equity, will be affected or limited by: the rights conferred upon the Commonwealth or Contract Administrator by clause 15 or the failure by the Commonwealth or the Contract Administrator to exercise any such rights; the obligations imposed upon the Consultant by clause 15 or the Consultant's compliance with those obligations; or any direction of the Contract Administrator under or purported to be given under the Contract, including any comment or direction upon or review, acceptance or rejection of: any advice, recommendation or other assistance provided by the Consultant under clause 15; or any post occupancy evaluation carried out (including any report prepared and finalised) under clause 15.5. General
Rights and Obligations Not Affected. Nothing in this Consent, and neither the giving of an Assumption Notice nor any assignment to a Third Party Transferee, shall release the Borrower from its obligations to the Shipper under and in relation to each Contract. Nothing in this Consent prevents or restricts the right of the Security Trustee to cure, or cause the cure of, any default of the Borrower under each Contract that would be curable by the Borrower, whether or not an Assumption Notice is given.

General
Rights and Obligations Not Affected. For the avoidance of doubt, this clause 14 does not limit any Party’s rights or obligations to use or disclose information as required by this Agreement or by Law.
Rights and Obligations Not Affected. The parties acknowledge that: the purpose of the KPIs is as set out in clause 18.1(b); and the parties' rights and obligations, whether under the Contract or otherwise at law or in equity, in relation to the Contractor's Activities, the Works or this Contract, will not be affected or limited by the provisions of this clause 18, anything done or omitted to be done under or purported to be under this clause, the KPIs or the Contractor's performance as against the KPIs.
