Rights and Remedies on Termination After Change in Control. The Executive will be entitled to receive the severance payments and severance benefits specified below in the event there shall occur a termination of the Executive’s employment pursuant to Paragraph (e) or (g) of Section 3.1 hereof within two (2) years following the occurrence of a Change in Control. The severance payments and benefits the Executive may be entitled to receive pursuant to this Section 3.4 shall be in addition to, and not in lieu of, any of the payments and benefits the Executive may be entitled to receive pursuant to Section 3.3 hereof, unless expressly so stated to be in lieu of such benefits and/or payments.
Rights and Remedies on Termination After Change in Control. If the Executive’s employment is terminated during the Term pursuant to Section 3.1 (e) in contemplation of or following a Change of Control, the Executive shall be entitled to receive the following payments and benefits in lieu of and not in addition to those provided under Section 3.3.
