Common use of Rights of Creditor Clause in Contracts

Rights of Creditor. Except to the extent required by applicable statute, no Company Interest (including any economic interest of the Company) shall be subject to foreclosure, even if it shall be proven that distributions under a charging order obtained by a creditor will not pay the creditor within a reasonable period of time. The capital needs, operating expenses and reserves of the Company shall all be taken into account when determining the time period that is reasonable.
