Common use of Road Surfaces Clause in Contracts

Road Surfaces. (1) Grade, shape, crown, and/or outslope surface and shoulders. (2) Provide leveling, patching, and/or reinforcement rock for restoring purposes. (3) Prevent contamination of road surface materials with soil and vegetative material. (4) Prevent road surface materials from being bladed off the road. (5) Temporarily cease road use to prevent and/or protect the road during adverse weather conditions. At the conclusion of log hauling operations, PURCHASER shall grade crushed rock surfacing on all roads used for hauling under this contract. Protection shall consist of measures necessary to prevent damage by the operations, and to keep the road passable during operating periods. Log hauling shall not be allowed from November 1 through April 30, unless otherwise approved in writing by STATE. Extraordinary maintenance is defined as major repair work and/or damage caused by acts of God or causes beyond the control of the PURCHASER, as defined in Section 28. STATE may require PURCHASER to perform extraordinary maintenance. STATE shall describe the amount and specifications of work to be done in writing, and make adjustments in accordance with Section 28. Prior to any rock spreading, PURCHASER shall grade crushed rock surfacing on all roads used for hauling under this contract. In addition to forest road maintenance required under this contract, PURCHASER shall protect the Hill County Road shown on Exhibit A. Protection shall consist of measures necessary to prevent damage by the operations, and to keep the road passable during operating periods. PURCHASER shall grade the road upon completion of operations or arrange with the county road department for final grading. Processing shall consist of loosening the existing road rock to a minimum depth of 3 inches and reprocessing according to the crushed rock “Compaction and Processing Requirements” in Exhibit C. PURCHASER may use rock from the STATE stockpile located in the XX0/0 XX0/4, Section 21, T3N, R8W, X.X., for maintenance on STATE roads used for hauling under this contractsurfaced with crushed rock. In addition Prior to forest road maintenance required under this contractany rock spreading, PURCHASER shall protect the Hill County Road shown on Exhibit A. Due to the Hill County Road shown on Exhibit A. Protection shall consist potential lack of adequate water sources, STATE may require other measures necessary to prevent damage by excessive dust. These measures may include any or all of the operationsfollowing: Limit speed of log trucks, and to keep the road passable during operating periods. PURCHASER shall grade the road upon completion restrict number of operations or arrange with the county road department for final gradingloads hauled per day, restrict consecutive haul days, and/or temporary suspension of hauling. Log hauling from Area I shall not be allowed from November June 1 through April 30September 1, unless otherwise approved in writing by STATE. Boundary markings are as follows: The Areas I, II, III, IV, and VI are posted with “Timber Sale Boundary” signs, fluorescent orange flagging, and fluorescent orange paint. All exclusion areas within the timber sale area is areas are posted with “Timber Sale Boundary” signs, fluorescent orange flagging, and fluorescent orange paint. The boundaries between Areas II and III, II and IV, II and V, III and IV, and III and V are posted with “Area Boundary” signs, blue flagging, and yellow paint. All road rights-of-way are posted with "Timber Sale Boundary" signs and pink flaggingRight-of-Way Boundary"signs. PURCHASER shall not have any blue paint on the timber sale area.

Protection shall consist of measures necessary A1 to prevent damage by the operationsA2, A2 to A3 from Station 0+00 to Station 6+00, and A1 to keep the road passable during operating periodsA7 from Station 0+00 to Station 25+00. PURCHASER Required replacement rock shall grade the road upon completion of operations or arrange with the county road department for final gradingbe obtained from a STATE approved commercial rock pit. Log hauling shall not be allowed on unsurfaced roads from November October 1 through April 30May 31, unless otherwise approved in writing by STATE. The boundaries between Areas I and II, and the Reserve Areas are marked with “Area Boundary” signs, blue and white striped flagging, and fluorescent red paint. PURCHASER shall not have any blue fluorescent red paint on the timber sale area.
