The main roles and responsibilities of the Department CEO under this Agreement are to: • provide annual allocations and forecasts; • provide performance management parameters; • support and collaborate with XXXXX to deliver services in accordance with the Act; and, • oversee compliance, performance and delivery of purchased activity. Additionally, the Department CEO is responsible for: • the Department’s compliance with the terms of this Agreement and with the legislative requirements of the Act; • purchasing of services from XXXXX that align with the WA Clinical Services Framework (CSF) and its 2020 Addendum, including the Hospital Services matrices and latest underlying demand and capacity modelling; • maintaining a public record of the CSF; • monitoring actual activity against endorsed role delineations, including acting as necessary if activity is underdelivered or budget parameters are not maintained; • undertaking of assurance activities consistent with the Department CEO’s identified strategic objectives. The Department CEO may audit, inspect or investigate XXXXX for assessing compliance with the Act (per section 175 of the Act); • providing XXXXX with access to all applicable Department policies and standards. The Department CEO must brief XXXXX about matters that XXXXX should reasonably be made aware of in order to provide health services in accordance with the terms of this Agreement; • communication of any proposed amendments to this Agreement or significant events that may result in an amendment to this Agreement; and, • publication of an abridged version of this Agreement on the WA Health internet site, in accordance with Schedule D9 of the NHRA. Any subsequent amendments to this Agreement will also be published in accordance with Schedule D9 of the NHRA.

Should NMHS be unable to deliver the level of activity that has been funded in this Agreement, the Department CEO has the discretion to determine whether a financial adjustment should be applied. This will follow a joint consultation process with NMHS to understand the cause of the under-delivery and any remedial action plan, • undertaking of assurance activities consistent with the Department CEO’s identified strategic objectives. The Department CEO may audit, inspect or investigate XXXXX NMHS for the purpose of assessing compliance with the Act (per section see s 175 of the Act); , • providing XXXXX NMHS with access to all applicable Department policies and standards.
