SAFEGUARDING AND SECURITY OF PROTECTED HEALTH INFORMATION. a. Business Associate shall use appropriate safeguards, including complying with Subpart C of 45 CFR Part 164 with respect to electronic Protected Health Information, to prevent use or disclosure of Protected Health Information other than as provided for by the Agreement.

Business Associate shall use appropriate safeguards, including complying safeguards and comply with Subpart C of 45 CFR Part 164 with respect to electronic 164, Security Standards for the protection of Electronic Protected Health Information, with respect to ePHI, to prevent use access, use, or disclosure of Protected Health Information ePHI other than as provided for by the this Agreement.

Business Associate shall develop, implement, maintain, and use reasonable and appropriate safeguardsadministrative, including complying with Subpart C technical, and physical safeguards that: (1) reasonably and appropriately safeguard the confidentiality, integrity, and availability of 45 CFR Part 164 with respect to electronic Protected Health InformationPHI, in any form of media, that it creates, receives, maintains, uses or transmits on behalf of the Covered Entity; and (2) to prevent use or and disclosure of Protected Health Information PHI other than as provided for by the this Agreement.
