Safety-Critical, Military and Automotive Applications. A&A MACHINE AND FABRICATION, LLC products are not authorized for use in safety-critical applications (such as life support) where a failure of the A&A MACHINE AND FABRICATION, LLC product would reasonably be expected to cause severe personal injury or death, military/aerospace operations, or automotive applications unless officers of the parties have executed an agreement specifically governing such use. Buyer shall fully indemnify A&A MACHINE AND FABRICATION, LLC and its representatives against any damages arising out of the unauthorized use of A&A MACHINE AND FABRICATION, LLC products in such safety-critical applications. Buyer is solely responsible for compliance with all legal, regulatory and safety-related requirements concerning its products and any use of A&A MACHINE AND FABRICATION, LLC products in Buyer's applications, notwithstanding any applications- related information or support that may be provided by A&A MACHINE AND FABRICATION, LLC.

IntelliProp Products are not intended or authorized for use in safety-critical applications (such as life support) where a failure of the IntelliProp Product would reasonably be expected to cause severe personal injury or death, unless officers of the parties have executed an agreement specifically governing such use. Buyer shall fully indemnify IntelliProp and its representatives against any damages arising out of the unauthorized use of IntelliProp Products in such safety-critical applications.

Web-based information and applications must conform to New York State Enterprise IT Policy NYS-P08-005 as determined by quality assurance testing. Such quality assurance testing will be conducted by the State Agency Authorized User and the results of such testing must be satisfactory to the Authorized User before web-based information and applications will be considered a qualified deliverable under the contract or procurement.
