Sanitization. [Subject to Section 21, Records Maintenance and Access, Contractor shall not retain any copies of Agency Data following the post-termination access period referenced in Section 2.8 of this exhibit.] [ Contractor shall not destroy Agency Data without Agency’s written authorization.] Contractor shall notify Agency of any conditions that make returning all Agency Data not feasible. Upon Agency’s written acknowledgement that returning all Agency Data is not feasible and consent, Contractor shall purge or destroy retained Agency Data in all its forms (including copies of returned data) in accordance with the most current version of NIST SP 800-88 [or other agreed-upon standard] and provide Agency with written certification of sanitization.

Guests who are under isolation or quarantine orders may not enter Mainstage 2021. If at any point during their visit that a guest does not meet all of the above criteria, they will be asked to leave the event. The obligation to destroy or return such Purchasing Entity Data will not apply to electronic copies stored pursuant to Contractor’s record retention policies and obligations (“Backup Copies”). Contractor will not be required to erase electronically stored Purchasing Entity Data that has been saved to Backup Copies in accordance with its standard electronic back-up practices, on the condition that, except as otherwise required by applicable law, (i) its personnel whose functions are not primarily information technology do not access such Backup Copies and (ii) its personnel whose functions are primarily information technology in nature access such Backup Copies only as reasonably necessary for the performance of their information technology duties (e.g., for purposes of system recovery). Contractor shall maintain protections required by law or a Contract for such Backup Copies for so long as Contractor retains them.

County shall notify ODHS of any conditions that make returning all such Data not feasible. Upon ODHS’ written acknowledgement that returning all Data is not feasible, County shall purge or destroy retained State of Oregon and ODHS Data in all its forms in accordance with the most current version of NIST SP 800-88 (or other agreed-upon standard) and on request provide ODHS with written certification of sanitization.

Common areas and frequently touched objects in those areas (tables, doorknobs, light switches, countertops, handles, desks, phones, keyboards, elevator switches and buttons, touch screens, printers/copiers, grab bars, and handrails) are to be disinfected three times daily using appropriate products. c. The District will use cleaning products that are effective against COVID-19 (as listed on the Environmental Protection Agency (EPA)-approved list N).
