Satisfaction of Conditions to Fourth Amendment. Upon the satisfaction of the conditions to the effectiveness of this Fourth Amendment, as set forth in this Article II hereof, Borrower shall execute and deliver to Bank a Certificate of Compliance, and if Bank has been reasonably satisfied that such conditions have been fulfilled, Bank shall contemporaneously provide a letter to Borrower and DHH stating "Bank One, Texas, N.A. is satisfied that the conditions set forth in Article II of the Fourth Amendment to that certain Loan Agreement dated October 25, 1996, among the Bank and Tanknology-NDE International, Inc. et al. have been fulfilled," whereupon this Fourth Amendment shall become effective.
