Common use of Savings and Severability Clause Clause in Contracts

Savings and Severability Clause. 40.01 If any provision of this Agreement is in contravention of the laws or regulations of the United States or of the State of South Dakota, such provision shall be superseded by the appropriate provisions of such law or regulation, so long as the same is in force and effect; but all other provisions of this Agreement shall continue in full force and effect. If the parties are unable to agree as to whether or not any provision hereof is in contravention of any such laws or regulations, the provisions hereof involved shall remain in effect until a court of competent jurisdiction, or other authority having jurisdiction in the matter settles the dispute.
