Common use of School Fees Clause in Contracts

School Fees. (a) All the costs incurred in the usual course of the education of the Pupil by the School, including the provision of any necessary educational materials (but excluding certain specialist textbooks, materials and or other associated costs, examinations fees and/or extra-curricular activities, as detailed further in Clause 3(b) below), shall be met by the Fees unless otherwise notified by the School. Loss of books or equipment or damage done by a Pupil other than fair wear and tear, may be separately invoiced and must be paid as extra. (b) Any extra-curricular activities such as private music lessons, trips and visits in which you agree in advance the Pupil may participate shall be deemed to be supplemental to items met by the Fees and charged for accordingly. In particular, all public examination charges, any additional charges incurred by the School in providing for the special educational needs of the Pupil and coach charges for bringing the Pupil to and from School shall be charged as supplemental to the Fees. (c) Fees charged to Parents by outside professionals such as, but not limited to, peripatetic music teachers, which remain outstanding at the end of the term to which they relate will be settled by the School and the amount owing will be treated as a supplementary charge and will be added to the Pupil’s next school ▇▇▇▇, the amount outstanding will become a debt owing to the School. (d) Each invoice for Fees and any extras chargeable in accordance with these Terms and Conditions will be collected by direct debit in full on or shortly after the first day of each Term unless arrangements have previously been made in writing to use the School’s approved monthly payment scheme. A Pupil may be excluded from the School at any time when Fees are unpaid and will be deemed withdrawn without notice 28 days after exclusion if Fees remain unpaid at the time. (e) Each Parent who has signed the Acceptance Form is liable for the whole of the Fees (jointly and severally) and any supplemental charges due, unless the School has agreed in writing for payment of the Fees (or any part of them) to be paid by another third party on behalf of the Parents (“Payer”). Such agreement for third party payment of fees must be in writing, with direct agreement from the Payer to settle payment of all Fees and any supplemental charges, for payment in accordance with these Terms and Conditions. (f) Where two Parents have signed the Acceptance Form, one of them may withdraw from the Contract with the School by submitting a Term's Notice provided they have obtained the prior written consent of both the School and the remaining Parent. (g) If the Pupil has been awarded a scholarship or bursary your liability for payment of Fees under this Contract will be for the amount of Fees due after taking into account that award. An award may be withdrawn if, in the opinion of the Headmaster, the Pupil’s attendance, progress or behaviour no longer merits the continuation of the award but any such withdrawal of an award will not operate so as to increase the Fees due in respect of a Term which has already commenced. Where it appears likely to the Headmaster that an award may be withdrawn in respect of a Pupil the circumstances will be discussed with the Parents and the required improvements will be confirmed in writing. If there is insufficient improvement in performance over such a period as the Headmaster may determine you will be notified that the award has been withdrawn. The withdrawal will be implemented from the commencement of the Term immediately following notification of the withdrawal of the award by the Headmaster. (h) We reserve the right to refuse to allow the Pupil to attend the School or to withhold any references while Fees and/or supplemental charges remain unpaid or there is a persistent default in relation to the payment of Fees and/or supplemental charges. We will normally make an interest charge of 2% per month for any late payments, calculated on a daily basis against outstanding monies due until such payment is due. You must pay the School the interest together with the overdue amount. (i) Unless we expressly agree otherwise in writing with you, if we reasonably and properly incur any costs (including legal costs, and in any event being such costs that would be allowable by the courts if judgement was made in the School’s favour) in recovering or attempting to recover Fees or supplemental charges from you (or either of you) that have not been paid in accordance with this Contract, then you shall be responsible for paying such costs in addition to the Fees and/ or supplemental charges (as the case may be) and any interest applied to such amount(s). (j) You consent to the School informing any other school or educational establishment to which you propose to send the Pupil of any outstanding Fees due to the School. (k) The Fees will be reviewed from time to time (usually annually) and may be increased by such amount as the School considers reasonable. Notice of an increase in the Fees will normally be sent to you prior to the commencement of the final Term in an academic year, before the increase is to take effect from the beginning of the Term of the next academic year. (l) Fees and any prepaid supplemental charges will not be reduced as a result of absence due to illness, non-attendance as determined by the Pupil and/or the Parents, or otherwise. In the event that the Pupil takes study leave at home before or during public examinations or stays at home following those examinations no reduction of Fees will be made in respect of such periods spent at home.

If the Pupil your child has been awarded a scholarship or bursary bursary, your liability for payment of Fees under this Contract will be for the amount of Fees fees due after taking into account of that award. Each term’s fees accrue separately and the fees payable in respect of a Pupil each term fall due on the circumstances day before term commences and will be discussed included in an invoice sent to those persons who signed the Acceptance Form (or such other person(s) the School has agreed shall pay the fees under section 3.3 above). The fees invoice must be paid in full by termly direct debit (or by direct bank transfer if expressly agreed with the Parents Director of Finance and Operations beforehand). 3.7. The School may agree that the required improvements fees that are or will fall due in relation to any term can be paid in instalments. If the School so agrees in relation to any term's fees, then the School and those liable for those fees will agree separately a schedule of instalments by which the deferred amount is to be paid. The agreed amount for each term is to be paid by direct debit in not more than four (4) instalments within a period that does not exceed twelve (12) months beginning with the date of the relevant invoice. The School shall issue a separate invoice and schedule of instalments relating to the fees due in respect of each term, which shall be evidence of the separate agreement for the payment of that term's fees. 3.8. Any and all additional charges for extra curricular activities for each term (and for other charges that were agreed during the previous term) will be confirmed in writing. If there is insufficient improvement in performance over detailed separately on your fees invoice and such a period as invoice shall be sent to you before the Headmaster may determine you will be notified that the award has been withdrawn. The withdrawal will be implemented from the commencement start of the Term immediately following notification of the withdrawal of the award by the Headmasternext term. All such additional charges must be paid in full in accordance with arrangements for fees. (h) 3.9. We reserve the right to refuse to allow the Pupil your child to attend the School or to withhold any references while Fees and/or supplemental charges remain unpaid or there is a persistent default in relation to the payment of Fees and/or supplemental chargescases where our fees are in default. We will normally may make an interest charge of 2% 1.5 per cent per month for any late paymentson the outstanding debt. Unless otherwise notified to you in writing, calculated this interest shall accrue on a daily basis against outstanding monies from the due date until such the date of actual payment is dueof the overdue amount, whether before or after judgment. You must pay the School the interest together with the overdue amount. (i) Unless we expressly agree otherwise in writing with you, if we reasonably and properly incur any . In addition there is a fixed rate payment penalty as shown on the Schedule of Fees. School Fees. (a) All It is the policy of the School to educate Students until the end of the academic year; fees are therefore paid with this in mind. While Students may join part way through the year, it is the School’s expectation that all Students complete each academic year. b) School Fees will normally be fixed by the School during the Spring Term to take effect for the next academic year. Fees are either paid a full year in advance by 1st August or termly as follows: • Autumn Term (Term 1) fees must be paid by 1st August (for new Students only) • Winter Term (Term 2) fees must be paid by 1st November • Spring Term (Term 3) fees must be paid by 1st February Invoices will normally be sent at least 1 month before the due date or as otherwise agreed. a) School Fees cover all the costs incurred in the usual course of the education of the Pupil generally offered by the School, including teaching materials, the provision main text books, some stationery and materials, the use of equipment and facilities, most activities onsite, transport to mid-week and day trips and activities offsite, pastoral care, and lunch. b) The costs of any necessary educational materials (but excluding certain specialist textbooks, materials and or other associated costs, examinations fees and/or extra-curricular activities, as detailed further in Clause 3(b) below), shall be met by the Fees unless otherwise notified provision made by the School. Loss of books , including trips, visits and activities offsite, public examinations taken, any special additional tuition including music and certain clubs and activities, courses not generally offered by the School, or equipment or damage done by a Pupil any other than fair wear and tearmatter not covered in (c) above, may be separately invoiced and must be paid as extrathe subject of Supplementary Fees or Extras. (c) Fees charged to Parents by outside professionals such as, but not limited to, peripatetic music teachers, which remain outstanding at the end of the term to which they relate will be settled by the School and the amount owing will be treated as a supplementary charge and will be added to the Pupil’s next school ▇▇▇▇, the amount outstanding will become a debt owing to the School. (d) Each invoice for Fees and any extras chargeable in accordance with these Terms and Conditions will be collected by direct debit in full on or shortly after the first day of each Term unless arrangements have previously been made in writing to use the School’s approved monthly payment scheme. A Pupil may be excluded from the School at any time when Fees are unpaid and will be deemed withdrawn without notice 28 days after exclusion if Fees remain unpaid at the time. (e) Each Parent person who has signed the Acceptance Form Parent Contract is liable for the whole of the School Fees (jointly and severally) due and any supplemental charges due, Supplementary Fees or Extras. The persons who have signed the Acceptance Form will remain liable to the School unless the School has agreed in writing to look exclusively to any other person for payment of the Fees (fees or any part of them) to be paid by another third party on behalf of the Parents (“Payer”). Such agreement for third party payment of fees must be in writing, with direct agreement from the Payer to settle payment of all Fees and any supplemental charges, for payment in accordance with these Terms and Conditions. (fd) Where two Parents have signed the Acceptance Form, one of them may withdraw from the Contract with the School by submitting a Term's Notice provided they have obtained the prior written consent of both the School and the remaining Parent. (g) If the Pupil has been awarded a scholarship or bursary your liability for payment of Fees under this Contract will Your Child shall not be for the amount of Fees due after taking into account that award. An award may be withdrawn if, in the opinion of the Headmaster, the Pupil’s attendance, progress or behaviour no longer merits the continuation of the award but any such withdrawal of an award will not operate so as to increase the Fees due in respect of a Term which has already commenced. Where it appears likely to the Headmaster that an award may be withdrawn in respect of a Pupil the circumstances will be discussed with the Parents and the required improvements will be confirmed in writing. If there is insufficient improvement in performance over such a period as the Headmaster may determine you will be notified that the award has been withdrawn. The withdrawal will be implemented from the commencement of the Term immediately following notification of the withdrawal of the award by the Headmaster. (h) We reserve the right to refuse to allow the Pupil allowed to attend the School or and we reserve the right to withhold any references while School Fees and/or supplemental charges remain unpaid or there is a persistent default in relation to the payment of Fees and/or supplemental chargesSupplementary Fees. We will normally make an interest charge of 2% per month for any late payments, calculated on a daily basis against outstanding monies due until such payment is due. You must pay the School the interest together with the overdue amount. (i) Unless we expressly agree otherwise in writing with you, if we reasonably and properly incur any costs (including legal costs, and in any event being such costs that would be allowable by the courts if judgement was made in the School’s favour) in recovering or attempting to recover Fees or supplemental charges from you (or either of you) that have not been paid in accordance with this Contract, then you shall be responsible for paying such costs in addition to the Fees and/ or supplemental charges (as the case may be) and any interest applied to such amount(s). (j) You consent to the School informing any other school or educational establishment to which you propose to send the Pupil of any outstanding Fees due to the School. (k) The Fees Late fees will be reviewed from time to time (usually annuallysubject to: a) and may be increased by such amount as the School considers reasonable. Notice of an increase in the Fees will normally be sent to you prior to the commencement of the final Term in an academic year, before the increase is to take effect from the beginning of the Term of the next academic year. (l) Fees and any prepaid supplemental charges Supplementary Fees will not normally be reduced as a result of absence due to illness, non-attendance as determined by the Pupil and/or the Parents, illness or otherwisefor other reasons. In the event that the Pupil takes study leave at home before or during public examinations or your Child stays at home following those public examinations or any other reason, no reduction of Fees fees will be made in respect of such periods spent at home. b) If one or more items on the School bill are under query, the balance of the bill must be paid.

If, within 14 days following the withdrawal of a bursary, a child is withdrawn from the School, no fees in lieu of notice will be payable. 3.8 Each term’s fees accrue separately and the fees payable in respect of a Pupil each term fall due on the circumstances day prior to the first day of that term and will be discussed included in an invoice which must be paid either in full in cleared funds before the first day of term or, if fees are paid by direct debit, in monthly instalments (each instalment being due on the first working day of each month). Any supplemental charges for extra-curricular activities for each term (and other charges that were agreed during the previous term) will be included in the invoice sent to those persons who signed the Acceptance Form. Unless otherwise notified to you in writing, this interest shall accrue on a daily basis from the due date until the actual payment of the overdue amount, whether before or after judgement. Where it appears likely to the Headmaster that Head that, for academic reasons, an award may be withdrawn from your child, you shall be notified in advance. If within fourteen (14) days following the withdrawal of a scholarship or bursary your child is withdrawn from the School, no fees in lieu of notice will be payable. If the School so agrees in relation to any term's fees then the School and those liable for those fees will agree separately in writing the amount of each term's fees that is to be deferred and the anticipated schedule of instalments by which the deferred amount is to be paid. In such circumstances and in any event, the agreed amount for each term is to be paid by direct debit in not more than four (4) instalments within a period that does not exceed twelve (12) months beginning with the Parents and date of the required improvements will be confirmed in writing. School Fees. (a) All It is the policy of the School to educate Students until the end of the academic year; fees are therefore paid with this in mind. While Students may join part way through the year, it is the School’s expectation that all Students complete each academic year. b) School Fees will normally be fixed by the School during the Spring Term to take effect for the next academic year. Fees are either paid a full year in advance by 1st August or termly as follows:  Autumn Term (Term 1) fees must be paid by 1st August (for new Students only)  Winter Term (Term 2) fees must be paid by 1st November  Spring Term (Term 3) fees must be paid by 1st February  For returning Students, Winter Term fees must be paid by 1st May Invoices will normally be sent at least 1 month before the due date or as otherwise agreed. a) School Fees cover all the costs incurred in the usual course of the education of the Pupil generally offered by the School, including teaching materials, most books, some stationery and materials, the provision use of equipment and facilities, most activities onsite, transport to mid-week and day trips and activities offsite, pastoral care, 3 meals per day at school and accommodation. b) The costs of any necessary educational materials (but excluding certain specialist textbooks, materials and or other associated costs, examinations fees and/or extra-curricular activities, as detailed further in Clause 3(b) below), shall be met by the Fees unless otherwise notified provision made by the School. Loss of books , including trips, visits and activities offsite, public examinations taken, any special additional tuition including music and certain clubs and activities, courses not generally offered by the School, or equipment or damage done by a Pupil any other than fair wear and tearmatter not covered in (c) above, may be separately invoiced and must be paid as extrathe subject of Supplementary Fees or Extras. (fd) Where two Parents have signed the Acceptance Form, one of them may withdraw from the Contract with the School by submitting a Term's Notice provided they have obtained the prior written consent of both the School and the remaining Parent. (g) If the Pupil has been awarded a scholarship or bursary your liability for payment of Fees under this Contract will Your Child shall not be for the amount of Fees due after taking into account that award. An award may be withdrawn if, in the opinion of the Headmaster, the Pupil’s attendance, progress or behaviour no longer merits the continuation of the award but any such withdrawal of an award will not operate so as to increase the Fees due in respect of a Term which has already commenced. Where it appears likely to the Headmaster that an award may be withdrawn in respect of a Pupil the circumstances will be discussed with the Parents and the required improvements will be confirmed in writing. If there is insufficient improvement in performance over such a period as the Headmaster may determine you will be notified that the award has been withdrawn. The withdrawal will be implemented from the commencement of the Term immediately following notification of the withdrawal of the award by the Headmaster. (h) We reserve the right to refuse to allow the Pupil allowed to attend the School or and we reserve the right to withhold any references while School Fees and/or supplemental charges remain unpaid or there is a persistent default in relation to Supplementary Fees. Late fees will be subject to:  A £200 penalty fee if not paid in full by the payment of Fees and/or supplemental charges. We will normally make due dates in (b) above or an interest charge of 23% per month APR (Annual Percentage Rate) above the Bank of England base rate in force at the time for any late paymentsfees more than one month overdue, calculated whichever is higher.  If any outstanding fees remain on the first day of term, a daily basis against outstanding monies due until such payment is due. (g) We reserve the right to refuse to allow the Pupil your child to attend the School or to withhold any references while Fees and/or fees or supplemental charges remain unpaid or there is a persistent default in relation to the payment of Fees and/or supplemental charges. We will normally make an interest charge of 2% per calendar month for any on late payments, calculated payment. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. (j) You consent to the School informing any other school or educational establishment to which you propose to send the Pupil of any outstanding Fees due to the School. This will include any period of absence required as a result of clause 8(a) below. (k) Without limiting the effect of the foregoing provisions of this Clause 3, where you and the School have entered into an agreement incorporating the Fees In Advance (FIA) Terms and Conditions such that you have made a capital payment in respect of all or part of the fees due under this agreement, the School will administer such capital sum to meet the fees. Provided that you shall meet the difference between the amount per term applied by the School under the FIA Terms and Conditions and the total fees and supplemental charges due in respect of your child each term under this agreement. For the avoidance of doubt, the School shall provide a termly statement of account in respect of the fees and supplemental charges and the difference shall be payable in accordance with the terms of this agreement.

All such supplemental charges must be paid in full by direct bank transfer by the first day of the then forthcoming term. f) The Fees will be reviewed from time to time (usually annually) and may be increased by such amount as the School considers reasonable. The withdrawal will be implemented from the commencement of the Term immediately If, within 14 days following notification of the withdrawal of a bursary, a child is withdrawn from the award by the HeadmasterSchool, no fees in lieu of notice will be payable. f) Each invoice must be paid either in full in cleared funds before the first day of term or, if fees are paid by direct debit or standing order, in monthly instalments (heach instalment being due on the first working day of each month) with supplemental charges being collected at the start of each term. (hd) We reserve The School may agree, in writing, with the parents to look to a third party for payment of the fees or any part of them. However, any agreement with a third party to pay the fees or any other sum due to the School does not release parents from any liability under this contract. (di) Each invoice for Fees and any extras chargeable in accordance with these Terms and Conditions will be collected by direct debit in full on or shortly after the first day of each Term unless arrangements have previously been made in writing to use the School’s approved monthly payment scheme. A Pupil may be excluded from the School at any time when Fees are unpaid and will be deemed withdrawn without notice 28 days after exclusion if Fees remain unpaid at the time. (e) Each Parent you who has signed the Acceptance Form is liable for the whole of the Fees (jointly and severally) fees due and any and all supplemental charges. And, each of you remains liable to the School for the whole of the fees and supplemental charges due, unless due UNLESS AND UNTIL the School has expressly agreed in writing with each of you to look exclusively to any other person for payment of the Fees fees and/or any supplemental charges (or any part of them) to be paid by another third party on behalf of the Parents (“Payer”). Such agreement for third party payment of fees must be in writing, with direct agreement from the Payer to settle payment of all Fees and any supplemental charges, for payment in accordance with these Terms and Conditions. (fii) Where two Parents have A person who has signed the Acceptance Form, one of them Form may withdraw from the Contract this contract with the School by submitting a Termterm's Notice provided notice AND PROVIDED THAT they have obtained the prior written consent of both the School and the remaining Parentother person who has signed the Acceptance Form. (giii) If the Pupil your child has been awarded a scholarship or bursary scholarship/bursary, your liability for payment of Fees under this Contract will be for the amount of Fees fees due after taking into account of that award. An award may be withdrawn in accordance with (or by reference to) the terms upon which such award is made and/or if, in the opinion of the HeadmasterHead, the Pupil’s your child's attendance, progress or behaviour no longer merits the continuation of the award award, but any such withdrawal of an award will not operate so as to increase the Fees fees due in respect of a Term term which has already commenced. Where it appears likely to the Headmaster that Head that, for academic reasons, an award may be withdrawn from your child, you shall be notified in advance. If within fourteen (14) days following the withdrawal of a scholarship or bursary your child is withdrawn from the School, no fees in lieu of notice will be payable. d) Each term's fees accrue separately and the fees payable in respect of a Pupil the circumstances each term fall due as follow: § Autumn term: 1st June preceding § Spring term: 1st November preceding § Summer term 1st March preceding The fees will be discussed with included in an invoice sent to those persons who signed the Parents Acceptance Form (or such other person(s) the School may have agreed separately shall pay the fees under Clause 3(c)(i) above). The fees must be paid in full by direct bank transfer net of any bank charges. e) Any and the required improvements all supplemental charges for co-curricular activities for each term (and for other charges that were agreed) will be confirmed invoiced separately and such invoice shall be sent to you upon registration for such activities. All such supplemental charges must be paid in writing. If there is insufficient improvement in performance over such a period as the Headmaster may determine you will be notified that the award has been withdrawn. The withdrawal will be implemented from the commencement full within two weeks of the Term immediately following notification date of the withdrawal of the award by the Headmasterinvoice. (hi) We reserve the right to refuse to allow the Pupil your child to attend the School or to withhold any references while Fees fees and/or supplemental charges remain unpaid or there is a persistent default in relation to the payment of Fees fees and/or supplemental charges. . ii) We will normally may make an interest charge of 2% 3 per month cent per annum above the base rate for the time being of the School's bank on any late payments. Unless otherwise notified to you in writing, calculated this interest shall accrue on a daily basis against outstanding monies from the due date until such the date of actual payment is dueof the overdue amount, whether before or after judgment. You must pay the School the interest together with the overdue amount. (iiii) Unless we expressly agree otherwise in writing with you, if we reasonably and properly incur any costs (including reasonable legal costs, and in any event being such costs that would be allowable by the courts if judgement judgment was made in the School’s 's favour) in recovering or attempting to recover Fees fees or any supplemental charges from you (or either of you) that have not been paid in accordance with the terms of this Contractcontract, then you shall be responsible for paying such costs in addition to the Fees and/ or fees and/or supplemental charges (as the case may be) and any interest applied to such amount(s). (jiv) You consent to the School our informing any other school or educational establishment to which you propose to send the Pupil your child of any outstanding Fees due to the Schoolfees or supplemental charges. (kg) The Fees fees will be reviewed from time to time (usually annually) and may be increased by such amount as the School considers reasonable. Notice of an increase in the Fees fees will normally be sent to you prior to the commencement end of the final Term in an academic year, penultimate term before the increase is to take effect from the beginning of the Term of the next academic yeareffect. (lh) Fees and any prepaid supplemental charges will not normally be reduced as a result of absence due to illness, non-attendance as determined by the Pupil and/or the Parents, illness or otherwise. School Fees. (a) All the costs incurred Fees may include alone or in the usual course combination any of the education of Registration Fee, the Pupil Deposit, tuition fees, fees for extra tuition, public examination charges, other extras such as clothing and equipment, photographs or other items ordered by the SchoolParents or the Child or charges arising in respect of educational visits, including or damage where the provision Child alone or with others has caused wilful loss or damage to School property or the property of any necessary educational materials other person (but excluding certain specialist textbooks, materials and or other associated costs, examinations fees and/or extra-curricular activities, as detailed further in Clause 3(b) below), shall be met by the Fees unless otherwise notified by the School. Loss of books or equipment or damage done by a Pupil other than fair wear and teartear excluded), may be separately invoiced and must be paid as extraor bank charges arising from default in Fees payment or late payment charges if incurred. (b) Any Private music lessons and certain extra-curricular sports and other activities such as private music lessons, trips may be subject to separate agreements between Parents and visits in which you agree in advance the Pupil may participate shall be deemed to be supplemental to items met by the Fees and charged for accordingly. In particular, all public examination charges, any additional charges incurred by the School in providing for the special educational needs providers of the Pupil and coach charges for bringing the Pupil to and from School shall be charged as supplemental to the Feesthese services. (c) Fees charged to Parents by outside professionals such as, but not limited to, peripatetic music teachers, which remain outstanding at the end of the term to which they relate will be settled by the School and the amount owing will be treated as a supplementary charge and will be added to the Pupil’s next school ▇▇▇▇, the amount outstanding will become a debt owing to the School. Such agreement for third party payment of fees must be in writing, with direct agreement from the Payer to settle payment of all Fees and any supplemental charges, for payment in accordance with these Terms and Conditions. (fd) Where two Parents have signed the Acceptance Entrance Form, one of them may withdraw from the Contract contract with the School by submitting a Term's ’s Notice provided they have obtained the prior written consent of both the School and the remaining Parent. An award Award may be withdrawn if, in the opinion of the HeadmasterHead, the Pupilyour Child’s attendance, progress or behaviour no longer merits the continuation of the award Award but any such withdrawal of an award Award will not operate so as to increase the Fees due in respect of a Term which has already commenced. Where You shall be notified in advance where it appears likely to the Headmaster Head that an award Award may be withdrawn in respect of a Pupil the circumstances will be discussed with the Parents and the required improvements will be confirmed in writingfrom your Child.
