Scope of Use and Disclosure by BA of County Disclosed PHI. A. BA shall not disclose PHI except for the purposes of performing BA’s obligations under the Underlying Agreement. Further, BA shall not use PHI in any manner that would constitute a violation of the minimum necessary policies and procedures of the County, Privacy Rule, Security Rule, or the HITECH Act.
