Common use of Section 3.4 Clause in Contracts

Section 3.4. 14 Neither the District, nor the Association, shall discriminate against any employee subject to this 15 Agreement on the basis of race, color, religion, creed, gender, age, national origin, marital status, 16 sexual orientation including gender expression or identity, veteran status, or physical, mental, or 17 sensory disability, the use of a trained guide dog or service animal by a person with a disability, or 18 honorably-discharged veteran or military status or any other basis prohibited by law, the duties of 19 which may be performed efficiently by an individual without danger to the health or safety of the 20 physically disabled person or others.

Section 3.4. 14 21 Neither the District, nor the Association, shall discriminate against any employee subject to this 15 22 Agreement on the basis of age, creed, religion, race, color, religion, creed, gender, age, national origin, sex, marital status, 16 sexual 23 orientation including gender expression or identity, honorably discharged veteran or military status, or physical24 the presence of any sensory, mental, mental or 17 sensory disability, the physical disability or use of a trained guide dog or service 25 animal by a person with a disability, or 18 honorably-discharged veteran or military status or any other basis prohibited by law, the duties of 19 which may be performed efficiently by an individual 26 without danger to the health or safety of the 20 physically disabled handicapped person or others.
