Common use of Section 3.4 Clause in Contracts

Section 3.4. 45 Neither the District, nor the Association, shall unlawfully discriminate against any employee with respect 46 to the employment of any person because of the person's age, gender, marital status, race, creed, color, 47 national origin, sexual orientation, or the presence of any sensory, mental, or physical handicap disability, 48 unless based upon a bona fide occupational qualification provided that the prohibition against discrimination 1 because of such handicaps disabilities shall not apply if the particular disability prevents the proper 2 performance of the particular worker or others involved.
