Common use of Section closure Clause in Contracts

Section closure. 16.7.1 Save and except as provided in Clause 16.6, the Mine Operator shall not shut down or de-commission any section of the Mines for undertaking maintenance or repair works, not forming part of the Maintenance Programme, except with the prior written approval of the Engineer in charge. Such approval shall be sought by the Mine Operator through a written request to be made to the Engineer in charge, and a copy thereof furnished to the Authority, at least 7 (seven) days before the proposed closure of such section and shall be accompanied by particulars thereof. Within 3 (three) days of receiving such request, the Engineer in charge shall grant permission with such modifications as it may deem necessary and a copy of such permission shall be sent to the Authority.
