Common use of Section closure Clause in Contracts

Section closure. 17.8.1. Upon notice given by the Authority to this effect prior to commencement of an Accounting Year, the Concessionaire shall, save and except as provided in Clause 17.7, not schedule a closure of any part of the Storage Facility at any time during a continuous period of 180 (one hundred and eighty) days as may be specified by the Authority for and in respect of such Accounting Year. 17.8.2. Save and except as provided in Clause 17.7, the Concessionaire shall not shut down or close any part of the Storage Facility for undertaking maintenance or repair works not forming part of the Maintenance Programme, except with the prior written approval of the Authority. Such approval shall be sought by the Concessionaire through a written request to be made to the Authority at least 7 (seven) days before the proposed closure of such section and shall be accompanied by particulars thereof. Within 3 (three) days of receiving such request, the Authority shall grant permission with such modifications as it may deem necessary. 17.8.3. Upon receiving the permission pursuant to Clause 17.8.2, the Concessionaire shall be entitled to shut down the designated section for the period specified therein, and in the event of any delay in re-opening such section, the Concessionaire shall pay Damages to the Authority calculated at the rate of 1% (one per cent) of the Fixed Storage Charge for each day of delay until the section has been re-opened for operations.

Such approval shall be sought by the Concessionaire through a written request to be made to the Authority Independent Engineer, and a copy thereof furnished to the Authority, at least 7 (seven) days before the proposed closure of such section and shall be accompanied by particulars thereof. Within 3 (three) days of receiving such request, the Independent Engineer and the Authority shall grant permission with such modifications as it may deem necessarynecessary and a copy of such permission shall be sent to the Authority. 17.8.3. 17.7.2 The provisions of clause 17.7.1 shall not apply to de-commissioning under Xxxxxx 17.6.1 or to closure of any section of the Heliport for a period not exceeding 6 (six) hours in a day at any time of the day specified by the Independent Engineer as off- peak period for this purpose. 17.7.3 Upon receiving the permission pursuant to Clause 17.8.217.7.1 , the Concessionaire shall be entitled to shut down close the designated section for the period specified therein, and in the event of any delay in re-opening such section, the Concessionaire shall pay Damages Damage to the Authority calculated at the rate of 10.1 % (zero point one per cent) of the Fixed Storage Charge Average Daily Fee for that section, for each day of delay until the section has been re-opened for operationstraffic.

Within 3 (three) days of receiving such request, the Authority shall grant permission with such modifications as it may deem necessary. 17.8.3. 17.13.3 Upon receiving the permission pursuant to Clause 17.8.217.13.2, the Concessionaire shall be entitled to shut down the designated section for the period specified therein, and in the event of any delay in re-opening such section, the Concessionaire shall pay Damages to the Authority calculated at the rate of 1% (one per cent) of the Fixed Storage Charge average daily Testing Charges for the immediately preceding month to the month in which such section closure occurs, for each day of delay until the section has been re-opened for operations.
