Security and preservation of Records. (1) The Provider must preserve and protect the safety, security, and confidentiality of the Records in accordance with best practice and its legal obligations, including that: (a) the Provider must have in place appropriate back-up and disaster recovery procedures to protect against loss of information; and (b) if the Provider ceases to provide some or all Services, it must ensure that all Records are properly preserved and transferred to any replacement provider as required by law or otherwise as appropriate.
