Selection and Powers of the Arbitrator. A. An impartial arbitrator shall be selected from a panel supplied by the Federal Mediation and Conciliation Service or the American Arbitration Association upon request of either party. In the event an arbitrator cannot be agreed upon, the agency selected will appoint one. The arbitrator’s decision shall be rendered as expeditiously as possible. The arbitrator’s fee and expenses shall be borne equally by both parties to the arbitration. Unless the parties expressly agree to the contrary, a stenographic transcript of the proceeding will not be made. Posthearing briefs shall not be filed unless mutually agreed or requested by the arbitrator. B. If the arbitrator finds a violation of the Agreement, he/she shall have the power to require compliance with the Agreement and to make any affected employee whole for any losses in compensation or other benefits incurred as a result of the violation. In the event of an award involving discharge or suspension, the arbitrator shall have the authority to direct reinstatement without loss of seniority or other benefits including back pay for all time lost. The decision of the arbitrator shall be final and binding upon the parties.
