Common use of Self-Administration of Medication Clause in Contracts

Self-Administration of Medication. by Students (i) the student’s parent or guardian submits to the board of education a written certification from the student’s physician specifying the specific medical condition necessitating self-administration, the medication to be administered, and the fact that the student is capable of and has been instructed in the proper method for self- administration of the medication; (ii) the student’s parent or guardian submits to the board of education written authorization from the parent or guardian for self-administration of the medication by the student; (iii) the board of education informs the student’s parent or guardian, in writing, that the district, its employees, and its agents must incur no liability as a result of the student’s self-administration of medication; and (iv) the student’s parent or guardian signs a statement acknowledging that the district, its employees, and its agents must incur no liability as a result of the student’s self- administration of medicine, and that they (the student’s parent or guardian) will indemnify and hold harmless the district, its employees, and its agents against claims arising out of the student’s self-administration of medication. In addition, the school nurse must maintain the student’s Individualized Health Care Plan (IHCP) and Individualized Emergency Health Care Plan (IEHCP) documenting the student’s medical needs and the need for self-administration of the specified medication, pursuant to
