Common use of Seller to Diagnose Clause in Contracts

Seller to Diagnose. ‌ Seller shall, if required by Buyer’s Representative in writing and under the direction of Buyer’s Representative, diagnose the cause of any Defect. Unless such Defect or its cause shall be one which Seller would otherwise be responsible for repairing, the costs incurred by Seller in diagnosing such defect shall, subject to this article 23, be borne by Buyer and added to the Purchase Price.
