Recall to Duty. (a) An Employee, whether required to be on call or not, and who is recalled to work after leaving the Employer’s premises will be paid for a minimum of three hours work at the appropriate overtime rate.
(b) The time spent travelling to and from the place of duty will be deemed to be time worked. Except that, where an Employee is recalled within three hours of their rostered commencement time, and the Employee remains at work, only the time spent in travelling to work will be included with the actual time worked for the purposes of the overtime payment.
(c) An Employee who is recalled to work will not be obliged to work for three hours if the work for which the Employee was recalled is completed within a shorter period.
(d) If an Employee is recalled to work, the Employee will be provided with transport to and from their home or will be refunded the cost of such transport.
Recall to Duty. (i) When an employee is recalled to duty to work overtime after leaving the work site he or she shall be paid for a minimum of three hour's work at the rate of double time for each time they are so recalled.
(ii) This clause shall not apply in cases where: -
(a) Where scheduled shift work is undertaken;
(b) It is customary for an employee to return to the Company premises to perform a specific job outside their ordinary working hours; or,
(c) Where overtime is continuous, subject to a reasonable meal break, with the completion or commencement of ordinary working time.
Recall to Duty. Where the Employer recalls an Employee to perform work the Employee will be paid for a minimum for 3 hours work in accordance with the overtime provisions in clause 166 (Overtime) of this Appendix. If work continues for more than the initial 3 hours, the Employee will be paid for the actual time worked in accordance with the overtime provisions in clause 166 (Overtime) of this Appendix. If an Employee is recalled to duty within 3 hours of ceasing a previous work period, the total work period prior to re‑commencement of the work on the recall will be included in calculating the hours of duty for the day, and will also be included for the purposes of calculating a 16 hour work period.
Recall to Duty. 15.1 An employee who is recalled to duty by the employer in response to an incident outside of ordinary hours will be paid a minimum of three (3) hours at prescribed overtime rates at the employee’s normal rate of pay.
15.2 Employees recalled to duty on their Programmed Day/s Off (PDO) will be paid at prescribed overtime rates until conclusion of the shift at their normal rate of pay or relevant incident responsibility rate, whichever is the greater.
15.3 Employees notified by the employer by 1700 hours the day before that they are required to work on their Rostered or Programmed Day Off will negotiate an alternative day/s off to be taken at a mutually agreed time within the following four (4) weeks.
15.4 If an employee is not on call or on standby outside ordinary hours, the employee is under no obligation to be recalled to duty unless they agree.
15.5 Employees who are requested and who agree to return from annual leave to attend an incident will be compensated for pre-paid accommodation and return travel from their leave destination to home at either First Class Rail Travel or economy air travel whichever is the least (and in each case taxis as necessary) for themselves and any dependants, or as prescribed in the relevant Award if a private vehicle is used. Employees will be further compensated for ordinary hours at normal rate of pay for all hours travelled. Employees will only be requested to return from approved leave in extreme circumstances e.g. skill requirement, severe labour shortage etc. Annual leave not used will be credited back to the employee.
Recall to Duty. 21.1 Where an employee is recalled to duty at a time when the employee would not ordinarily have been on duty, and no notice of such call was given to the employee prior to ceasing ordinary duty, the employee will be paid Recall to Duty. Recall to Duty payment through the salary system will be the standard form of recompense. Recall to Duty is paid at the rate of double time. The minimum payment for Recall to Duty will be two hours at double time.
Recall to Duty. There is no requirement for a 10 hour break:
(a) between the end of a shift and the commencement of a recall to duty; and
(b) after the end of a recall to duty and the commencement of the next rostered shift.
Recall to Duty. Employees on vacation maybe recalled to duty only for true emergency situations.
Recall to Duty. 26.4.1 If an employee is recalled to work overtime (whether notified before or after leaving the Company's premises) the employee must be paid a minimum of four hours at the appropriate rate for each recall.
26.4.2 If the employee works for more than four hours, the employee must be paid for the period actually worked.
26.4.3 This clause does not apply if the overtime is continuous (subject to a meal break) with the completion or commencement of ordinary time.
Recall to Duty. 52.1. An Employee recalled to work overtime after leaving the Employer’s premises shall be paid for a minimum of three (3) hours work at the appropriate overtime rates.
52.2. The Employee shall not be required to work the full three (3) hours if the job can be completed within a shorter period.
52.3. When an Employee returns to the place of work on a number of occasions in the same day and the first or subsequent minimum pay period overlap into the next call out period, payment shall be calculated from the commencement of the first recall until either the end of duty or three (3) hours from the commencement of the last recall, whichever is the greater. Such time shall be calculated as one continuous period.
52.4. When an Employee returns to the place of work on a second or subsequent occasion and a period of three (3) hours has elapsed since the Employee was last recalled, overtime shall only be paid for the actual time worked in the first and subsequent periods with the minimum payment provision only being applied to the last recall on the day.
52.5. A recall to duty commences when the Employee starts work and terminates when the work is completed. A recall to duty does not include time spent travelling to and from the place at which work is to be undertaken.
52.6. An Employee recalled to duty within three (3) hours of the commencement of usual hours of duty shall be paid at the appropriate overtime rate from the time of recall to the time of commencement of such normal work.
52.7. This clause shall not apply in cases where it is customary for an Employee to return to TAFE NSW’s premises to perform a specific job outside the Employee’s ordinary hours of duty, or where overtime is continuous with the completion or commencement of ordinary hours of duty. Overtime worked in these circumstances shall not attract the minimum payment of three (3) hours unless the actual time worked is three (3) or more hours.
Recall to Duty. The minimum payment for a Staff Member who is recalled to duty at their normal place of work or at remote location will be 3 hours, at the appropriate Overtime rate as per clause 26.6, Payment for Overtime. Provided that this payment will also cover any further required return to duty during the 3 hour period. If a Staff Member is recalled to duty more than once within a period of less than 10 hours of completing their last duty, each period after the initial 3 hour period will be considered a stand-alone period.
